Terms of sale

of Mineralica for sales on Mineralica Auctions

Last updated: October 14, 2026

1. Scope and contracting party

1.1 These terms apply to all lots that Mineralica sells on Mineralica Auctions. How bids are placed and how the purchase contract is concluded is set out in the auction rules of Mineralica Auctions.

1.2 Your contracting party is Mineralica, owner: Maximilian Schiller, Klosterholz 5, 94491 Hengersberg, Germany. Postal address: Mineralica, Postfach 86 06 47, 81633 München, Germany. Phone: +49 89 2153 7111. Email: info@mineralica.com.

1.3 We treat all buyers as consumers: the right of withdrawal under section 8 and the statutory rights in case of defects under section 9 apply to every buyer, including buyers who purchase for a business.

2. Conclusion and text of the contract

2.1 Under the auction rules, the purchase contract is concluded when the auction ends: between us and the bidder who then holds the highest bid, at the hammer price.

2.2 After the auction ends, you receive a contract confirmation by email. It contains the lot, the hammer price, the shipping costs, these terms, the auction rules, and the withdrawal policy with the model withdrawal form. We store the text of the contract. You can see your purchases in your account.

2.3 The contract language is English.

3. The lots

3.1 Every lot is a unique specimen. We describe it on the lot with its mineral, locality, dimensions, and condition, and we name any damage, repairs, and treatments known to us. The photographs show the specimen you receive.

3.2 We do not offer radioactive specimens or asbestos minerals in fibrous form.

4. Prices and shipping costs

4.1 The hammer price is the final price for the lot. As a small business under Section 19 of the German VAT Act, we do not charge VAT.

4.2 Shipping costs are added to the hammer price. They depend on the size of the lot and on the shipping country and are shown on every lot. Before you bid, we show you the amount for your shipping country.

4.3 If you win several lots from us and pay for them together, we ship them in one parcel. You then pay shipping once, calculated for the largest lot.

4.4 We do not charge a buyer's premium or any other fee.

4.5 For deliveries to countries outside the European Union, import charges may apply, such as import VAT, customs duties, and carrier fees. They are not included in the price. The recipient bears them.

5. Payment

5.1 The hammer price and the shipping costs are due when the auction ends. Please pay within 7 days of the end of the auction.

5.2 You pay at the Mineralica Auctions checkout by credit or debit card. Payments are handled by our payment provider Stripe. Cash payment is not possible.

5.3 We ship a lot as soon as it has been paid for.

5.4 If you do not pay within the period set out in section 5.1, you are in default. We will then write to you by email and set a grace period of 7 days.

5.5 If you do not pay within the grace period either, we may withdraw from the purchase contract. We declare the withdrawal by email. After that we may offer the lot again.

5.6 We do not charge reminder fees, a contractual penalty, or a flat-rate charge. Our statutory claims in the event of default remain unaffected.

6. Delivery

6.1 We deliver worldwide, except to the United Kingdom, Russia, Belarus, Iran, North Korea, and Syria. Every lot shows whether we deliver to your country before you bid.

6.2 We deliver to the shipping address you provide at checkout. If it is in a different shipping country from the one for which we showed you the shipping costs before you bid, the shipping costs for the country of the shipping address apply. They are shown on the lot.

6.3 We hand the parcel to the carrier within 5 business days of receiving your payment. It reaches you no later than 10 days after we receive your payment for delivery in Germany, no later than 16 days for delivery to the rest of the European Union, and no later than 35 days for delivery to all other countries.

6.4 We ship as an insured parcel with tracking. As soon as your lot is on its way, we let you know by email.

6.5 If a lot arrives damaged or does not arrive at all, please write to us, ideally with photographs of the packaging and the specimen if it is damaged. Your statutory rights do not depend on this.

6.6 The lot remains our property until it has been paid for in full.

7. Invoice

If you are buying for a business, a club, a museum, or another institution, please say so at checkout. You will then receive an invoice. We issue an invoice to all other buyers on request.

8. Right of withdrawal

8.1 You have a statutory right of withdrawal of 14 days from the day on which you receive the lot. The withdrawal policy sets out the details.

8.2 Please pack the specimen for its return as securely as you received it.

9. Rights in case of defects

The statutory rights in case of defects apply in full.

10. Liability

10.1 We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and to the extent we have given a guarantee.

10.2 In the case of a slightly negligent breach of an essential contractual obligation, our liability is limited to the damage that was foreseeable when the contract was concluded and is typical for this kind of contract. Essential obligations are those whose fulfillment makes the contract possible in the first place and on whose observance you may regularly rely.

10.3 Otherwise we are not liable for slight negligence.

10.4 These rules also apply to the liability of our employees and agents. Your rights in case of defects under section 9 remain unaffected.

11. Final provisions

11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence in another country, the mandatory consumer protection provisions of that country remain applicable.

11.2 If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Deggendorf, Germany.

11.3 We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

11.4 If a provision of these terms is invalid, the remaining provisions remain valid.

Withdrawal policy

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (Mineralica, owner: Maximilian Schiller, Klosterholz 5, 94491 Hengersberg, Germany; postal address: Postfach 86 06 47, 81633 München, Germany; phone: +49 89 2153 7111; email: info@mineralica.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at https://mineralica.com/en/withdraw. If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us (Mineralica, Klosterholz 5, 94491 Hengersberg, Germany), without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
